Motions for Contempt
A person can be found in contempt for willfully failing to comply with a court order. A court order is a direct decree from the court and can be an agreement of the parties (such as a divorce agreement) or a direct ruling from a judge. Some common ways to be held in contempt are failing to pay child support or alimony, failing to comply with a visitation schedule, failing to sell marital property, or failing to comply with the automatic orders (i.e. taking a spouse off the medical insurance, incurring unreasonable debt, etc.). Having a attorney to help you defend or bring a contempt motion is extremely important. The stakes of a contempt hearing can be high. If a party is found to be in willful contempt, the judge can order the party to comply with the court order, pay the other party’s attorney fees and in some cases be sent to jail.
Don’t let this happen to you. Do not try to defend or bring a contempt motion on your own. Contact the attorneys at Goldblatt, Marquette & Rashba, PC today for a consultation.
